Sen. Julia Salazar proposed a bill that sounds a lot like universal rent control. But the measure isn’t technically about that.
The legislation is about preventing wrongful evictions, but a clause in the measure bars landlords from kicking out a tenant whose rent was increased by an “unconscionable” amount. That means eviction based on nonpayment of a rent increase of more than 150 percent of the regional Consumer Price Index (about 3.3 percent this year), would be illegal, Will Parker reports. Because we’re talking market-rate, unregulated units, this language is striking. There isn’t a law on the books – as of yet – that prevents landlords from increasing rent by that amount. In the wondrous land across the Hudson*, tenants can fight eviction in court by arguing that they were subject to an “unconscionable” rent increase. It’s up to the judge to decide what that means exactly.
And so, though Salazar’s bill defines such an increase, the fact that nothing is technically stopping owners from implementing such hikes could – if the bill passed as is – lead to a high volume of landlord-tenant stalemates (and a flood of new cases in housing court). But the legislation is being billed as a stepping stone to universal rent control, so we can likely expect more proposals in the coming months.
*New Jersey, of course. I’m sure you’ve heard that adjective used in reference to the state.
